Having developed programming for the past ten years, we have created tools and procedures that help us manage the process more efficiently. This includes the use of an Exclusivity Agreement.
An “Exclusivity Agreement” is a contract we use when we work with new talent (hosts, characters, etc.). We generally have two types of Exclusivity Agreements – a “Program Sales Agreement,” and a “Representation Agreement.”
Representation Agreement – This Agreement’s most important provision is that 24fps Productions will represent you within various show ideas submitted to the networks. It is not an Agent contract, and if you already have agency representation, this Agreement will not conflict with that. The purpose of this is to basically protect 24fps’s time spent working on developing show ideas and pitches featuring you.
Program Sales Agreement – This Agreement is used for instances where the Talent already has a developed show idea (with footage, etc.). This also includes a provision for representation as well as a provision for 24fps’s role should the show idea(s) be greenlit by the networks.
There is generally no cost to you involved with these Agreements, other then the costs you might incur having your attorney review.
